PulseNet Internet Service Agreement & Acceptable Use Policy

1. Terms of Use

PulseNet accounts may only be used for lawful purposes. Transmission of any material in violation of any federal, state, or local regulation is prohibited and will result in termination of services provided by PulseNet. PulseNet does not own or control many of the various facilities, telecommunication lines, or computing resources to which it may provide access. Use of other organizations' computing resources must comply with the policies of that other organization. Reliance on or use of any information obtained via PulseNet is at your own risk, and PulseNet specifically denies any responsibility for accuracy or quality of information obtained through its network.

2. Billing Procedures & Account Management

You will be billed each term for services purchased from PulseNet. Those desiring to be invoiced will receive an invoice in the US mail with a statement and return envelope.  Those choosing to pay via credit card or direct bank draft withdrawal will have the required amount charged to their credit card or automatically withdrawn from their account on a 30 day per month payment term. Applicable charges will be made for any services ordered from PulseNet.  Those who feel they have been inappropriately billed should immediately contact support@pulsenet.net

PulseNet is not responsible for, nor has any connection to any long distance charges incurred while using our services. PulseNet is neither responsible for, nor has any liability for any long distance charges incurred by you our customer while using our services. Any such long distance charges are solely your responsibility to your long distance carrier. It is the customer's final responsibility to ensure the number they are dialing is a local call.

A charge of $10.00 may be incurred by you to re-activate your account upon being suspended for a non-timely payment.

Early cancellation:

A user may terminate services through PulseNet at any time in the term period, refunds will be offered per the following schedule:

Monthly account No refund
Quarterly account No refund

Semi-Annual account Monthly charge at the current rate plus $35 accounting fee.

Example customer was on for part of one month: Current rate 59.70 minus (9.95 + 35.00) = 14.75 refund
Yearly account Monthly charge at the current rate plus $35 accounting fee.

For example, if a customer was on for part of one month the refund is equal to: (the current rate $119.40 per year for new customers) minus (the monthly charge of $9.95 + $35.00 service fee) = $74.45 refund

Other charges:

Users may at any time during a service term purchase additional services from PulseNet, including but not limited to additional electronic mail account and additional Internet server space.  

In addition to the amount of the check, a $30.00 fee will be charged for any returned checks. The account will remain deactivated until payment has been made.

3. Privacy

User Information Confidentiality

User information is considered confidential and will not be made available to any marketing firms, government agencies (unless directed by a court), or other groups. User information may be used to evaluate system performance and usage (the gathering of normal operating system usage information). While some of this information may be used to identify individual users, any records concerning user activities will be kept strictly confidential.  In most cases, individual user information will not be stored beyond the required time necessary to compile general usage statistics.

Usage Monitoring

Electronic mail, Internet chat, Internet 'surfing' are not monitored and are considered to be strictly private. PulseNet does not regulate or monitor its users' Internet usage except where that usage exceeds the terms set forth by this agreement or to preserve the integrity of our network and associated services. We do not exercise editorial control over the content of any web site, electronic mail transmission, or any other material existing on or accessible through our network. Users will not have access to read other users' electronic mail nor will files stored in a user's home directory on the FTP server be publicly available unless the user chooses to make them so.

Usernames & Passwords

Upon signing up with PulseNet each user chooses username(s) and password(s) with which to identify the user to PulseNet. Do not share your password with others, as it will allow access to your account. You will be responsible for any charges or damages incurred by you while using your account. If account security is in any way compromised, please contact PulseNet with the nature of the compromise. Passwords will be changed free of charge. A change of user name will incur a charge of $10 to the customer.

Privacy Disclaimer

Be aware no computer security system, no matter how extensive or elaborate, can absolutely guarantee that others will not be able to find a way to access data or electronic mail which they are not authorized to access. Thus, while PulseNet will try to provide users with a secure electronic environment, we cannot guarantee the absolute privacy or confidentiality of any specific files on the system.

4. Acceptable Usage Policy

PulseNet reserves the right to remove any materials that, in our discretion, may be illegal, subject us to liability, or which may violate this usage policy. PulseNet may cooperate with legal authorities and/or other parties in the investigation of any suspected or alleged crime or civil wrong. Violation of this Usage Policy may result in the suspension or termination of your access to services and/or your PulseNet account.

Violations of the Acceptable Usage Policy include but are not exclusive to

  1. Maintaining a dialup connection using software of any type while you are not actively using the connection. 'Unlimited access' does not mean continuously connected (24 hrs). You are authorized to maintain a connection while physically at the computer that is connected to the service. You are not authorized to maintain a connection while away from your computer or to use a program that will maintain a connection while you are away from your computer.  Inactive connections will be dropped after 30 minutes.  An inactive connection is defined as not passing any IP packets.

  2. Using services to transmit any material or commit any act that, intentionally or unintentionally, violates any applicable local, state, national or international law.

  3. Using services to harm, harass, threaten, or impersonate any other person or user.

  4. Using services to making fraudulent offers to sell or buy products, items, or services or to advance any type of financial scam.

  5. Using services to transmit any unsolicited commercial or bulk email, also called "spam". Attempts to distribute Spam may be subject to a $1.00 per message charge.  The point at which email is considered "spam" is determined by PulseNet and is generally when you send email to unknown recipients.

  6. Using services to access or to attempt to access any account not belonging to the user or to penetrate or attempt to penetrate security measures of PulseNet's or any other entity's computer software or hardware, electronic communications system, or telecommunications system, whether or not the intrusion results in the corruption or loss of data.

  7. Copyright or trademark infringement. Using services to transmit any material that infringes any copyright, trademark, patent, trade secret, or other proprietary rights of any third party, including, but not limited to, the unauthorized copying of copyrighted material, the digitization and distribution of photographs from magazines, books, or other copyrighted sources, and the unauthorized transmission of copyrighted software.

  8. Using services to collect personal information about third parties without their knowledge or consent.

  9. Reselling services without PulseNet's written permission.

  10. Using services for any activity which adversely affects the ability of other people or systems to use PulseNet or the Internet. Interference with or disruption of other network users, network services, or network equipment is prohibited. Users may not permit their network to be configured in such a way that gives a third party the capability to use their network in an illegal or inappropriate manner.

  11. Static IP addresses will not be assigned to dial-up customers.

Reporting Acceptable Usage Policy Violations PulseNet requests that anyone who believes that there is a violation of this Acceptable Usage Policy contact us by phone 1-877-716-2002 or email abuse@pulsenet.net

If available, please provide the following information:

  • The IP address used to commit the alleged violation
  • The date and time of the alleged violation
  • Any evidence of the alleged violation
  • Any other information thought relevant to the violation
All email complaints MUST include Full Header Information to be process by our Abuse Team. Incomplete submissions will be returned to sender. Complete submission may not receive any follow up to maintain customer privacy. Should you require follow up, please contact our office at (724) 225-5200 to open a ticket.

5. Disclaimers

You are solely responsible for determining if use of a particular technical support or dialup number will cause you to incur long distance, toll, or other charges. As previously addressed in Section 2 above, PulseNet is not responsible for any long distance, toll or other telecommunications charges you incur. PulseNet reserves the right to change prices and institute new fees at any time without prior notice.

PulseNet reserves the right to revise, amend, or modify this Service Agreement, Acceptable Use Policy, and any other policies at any time and in any manner. Any revision, amendment, or modification will be effective upon its posting on PulseNet web site (http://www.PulseNet.net). Terms and conditions are subject to change at any time.
